Do we? The report says that it contributed to the death. Without the restraint he would not have died there. He may have died a day later from a heart attack but the police would not have been responsible for that.

Whatever. The restraint was a contributing factor. You can speculate whether he would have died without the officer kneeling on his neck, but the fact is he died while the restraint was being applied. So the officer is responsible and has been charged.
