Their whole argument hinges on Flynn being legitimately investigated but by the nature of the call, there’s no real legal issue. He was an incoming official. He never negotiated on anything but wanted to establish rapport and stabilize tensions between Russia and America. There never was a threat of Logan violations.
The FBI knew going in there wasn’t a legal issue. They stated this. By January 5th there was no need for anyone in the administration to discuss it. The matter should have been closed. It should have been purely a matter of trivia. No need to even involve Obama or anyone outside the CIA, NSA, or FBI.
The only reason to discuss it at this point was to lay a foundation for how it can be used down the line to damage the Trump administration. Period.
