The Court arrogated Law to rule as it did.

Or what do you think, if it is per Marbury “worse than a solemn mockery” to require justices to take their oath of office and then make them close their eyes to the Constitution and see only statutes then what is it to require anyone who takes an oath to uphold the Constitution to close their eyes to the Constitution and see only the rulings of the Court?
I’m not saying I like it. I don’t.
But it is, as they say, “settled law”.
