Is Oregon in a declared state of health emergency?

If so, the state supreme court will certainly support the governor’s position.

Our church is involved in this lawsuit. The governor is in an untenable position. If she’s using health emergency she has wide powers but only for 28 days. After 28 days she must have approval from 3/5 of both sides of legislature. If she’s declaring a broad emergency it can last much longer but affords her very little powers. Certainly not the power to cutail business or detain people.

No, they won’t. If Brown wants a state of health emergency, then she needs to get legislative approval.

Oregon’s statute limits it to 28 days unless extended by the legislature and Brown has not sought their approval for her 60 and 90 day extensions.

The dems own the legislature but it appears she doesn’t have this vote locked down or she would have called them in to vote on it.

They didn’t argue the science, they argued the law and Kate Brown is not following the law.
