Federal court revives emoluments lawsuit against Trump over DC hotel (deep state in panic mode)

The Fourth Circuit Court of Appeals on Thursday revived a lawsuit from the Maryland and Washington, D.C. attorneys general that accuses President Trump of violating the Constitution’s Foreign and Domestic Emoluments Clauses by benefiting from use of the Trump International Hotel by foreign and U.S. officials.

The case previously had been ordered dismissed by a Fourth Circuit panel. But the full roster of judges reheard the case and, in a 9-6 decision, determined Trump cannot have the court overrule a lower court’s decision to deny him certification to appeal before trial.

“Notably, notwithstanding the President’s vigorous assertion that the court erred in its legal analysis, he does not contend that the district court denied certification for nonlegal reasons or in bad faith,” said Thursday’s opinion, written by Judge Diana Gribbon Motz.

Judge Motz [Clinton] wrote the majority opinion, in which Chief Judge Gregory [Clinton] and Judges King [Clinton], Keenan [Obama], Wynn [Obama], Diaz [Obama], Floyd [Obama], Thacker [Obama], and Harris [Obama] joined. Judge Wynn [Obama] wrote a concurring opinion, in which Judges Keenan [Obama], Floyd [Obama], and Thacker [Obama] joined.

Judge Wilkinson [Reagan] wrote a dissenting opinion, in which judges Niemeyer [G.H.W. Bush], Agee [G.W. Bush], Richardson [Trump], Quattlebaum [Trump], and Rushing [Trump] joined. Business at the hotel has been so bad since the economy crashed that The Trump Organization is trying to renegotiate the lease. Hard to see how Trump is benefitting from foreign governments under these conditions.

Currently, there are 8 ‘Rat appointees and 7 GOP appointees. Today’s decision was 9-6, with faithless Bush 43 appointee Roger Gregory voting with the 8 ‘Rats. The author of the majority opinion, Diana Motz from Baltimore, is a particularly nasty ‘Rat.
