If they will go to this extent to fix an election, what makes people think they wouldn’t get involved in spreading a virus around as well? This coronavirus works a little to well for Democraps doesn’t it. It put an end to Trump rallies, destroyed his top two running platforms: Jobs and the economy and gives them an excuse to further rig the election with mail in votes.

And the fact that there is no precedent that anybody can find for someone who has been charged with perjury just getting off scot-free. That’s the kind of stuff where you begin to get worried that basic — not just institutional norms — but our basic understanding of rule of law is at risk.

That was former president Barack Obama last week after the DOJ dropped the case against former National Security Advisor Michael Flynn, who had not been “charged with perjury,” or anything else.

Obama is wrong and the author of the article is wrong. Flynn still stands charged and convicted of lying to a federal officer, in violation of 18 U.S.C. 1001.

(a) Except as otherwise provided in this section, whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully— . . . (2) makes any materially false, fictitious, or fraudulent statement or representation; . . . shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both. . . .

It is not under oath, and is therefore not perjury.

The case is dropped when the judge says it is dropped.

The indictment of Roger Clemens had Counts 2-4 for False Statements (18 U.S.C. § 1001(a)(2); and Counts 5-6 for Perjury (18 U.S.C. § 1621(1)).
