Earlier Thursday, the top prosecutor on the case, Brandon Van Grack, abruptly withdrew from the case, without explanation, in a brief filing with the court.
Breadcrumbs were being dropped in the days preceding the decision that his case could be reconsidered. Documents unsealed a week ago by the Justice Department revealed agents discussed their motivations for interviewing him in the Russia probequestioning whether they wanted toget him to lie so he'd be fired or prosecuted, or get him to admit wrongdoing. Flynn allies howled over the revelations, arguing that he was essentially set up in a perjury trap. In that interview, Flynn did not admit wrongdoing and instead was accused of lying about his contacts with the then-Russian ambassador to which he pleaded guilty.
Then on Wednesday, the DOJ released a mostly unredacted version of former acting Attorney General Rod Rosensteins August 2017 scope memo, outlining the authority then-Special Counsel Robert Mueller had for his investigation. That document revealed for the first time that Muellers authority went significantly beyond what was previously known.
Rosensteins memo was known to have authorized Mueller to probe any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump, and any matters that arose or may arise directly from the investigation, and any other matters within the scope of [obstruction of justice laws].
But the new document made clear that Rosenstein authorized a deep-dive criminal probe into the Trump campaign that extended well beyond Russian interference efforts.
The memo revealed that Mueller was, among other things, looking into whether Flynn committed a crime or crimes by engaging in conversations with Russian government officials during the period of the Trump transition.

Dunno about him suing the DOJ. I appreciate what you are saying from the retribution standpoint, but they would probably dribble out discovery docs ultra slowly, dragging their feet every step of the way. Meaning; it would NOT be interesting, IMHO. Regardless, they would NEVER suffer any sanctions for impeding the trial. Kinda like they’ve done. That would be 5 years, probably cost $2 MM in legal fees. In the end, if he won, he’d collect the value of his house (let’s imagine $750K) and $2 MM in legal fees, and after he paid Sydney Powell he’d collect $50K a year for the grief. Maybe I’m all wrong and he collects $5 or $10 MM. But it wouldn’t be for 5 years, that you can count on.

If it had gone to trial two years ago, Flynn would be doing hard time as we speak.
The system, up down and sideways was populated by derps. It took a while to remove/insert. That's a Q term for remove the derps and insert good people.
The last blockade was DNI Coats, who was holding up release of the DECLAS. Once Grenell DECLAS'd this latest batch, there was nothing the derps and the derp judge could do. It was overwhelming.
Also, think of what DECLAS due to the Flynn case introduced into the legal system and the public domain. As noted above, the information used to FREE FLYNN is being used in Grand Jury cases against other derps.
