While he had been elected to Congress, Nixon could have appointed anyone as his VP.
But he would not have been elected AS PRESIDENT. Thats the point this guy is making. And although the 12th amendment states that you cant be elected as VP if youre ineligible as president, his point is that Obama would NOT be ineligible since he could succeed to the Presidency under the 22nd amendment under his interpretation.
I dont think the Supreme Court would uphold that interpretation though. Under his interpretation if he succeeded Hillary in the first two years of her term then hed have to step down after two years because the provision states that he cant be elected twice if he serves more than two years of someone elses term but he has already been elected twice.
