Are they going to lock people up who run a black market business?
I think that has a "practical" answer. Black markets are, by definition, illegal, somehow violating a regulation or law.
So, first there is the issue of getting caught. Then there is the issue of being hauled before a tribunal for the violation.
Will some governments lock some up? Maybe. But then they face the jury, the public, etc.
There is also the possibility that some people asked to be locked up, in order to shine some light on what the law is. Nothing better to do, might as well be locked up.
