A Hillary Clinton/Barack Obama Ticket To Replace Joe Biden?

Desperate times do indeed call for desperate measures. For the Democrats, a truly desperate time could come if Joe Biden is forced to withdraw from the presidential race. While the former vice president is the presumptive Democratic nominee to face off against President Trump in November, his nomination is still far from official.

Some Democrats tell me they fear that Biden’s political survival is getting more problematic with each passing day. They cite three main issues. The first is their concern that an allegation of sexual assault leveled against Biden by former staffer Tara Reade won’t go away anytime soon. If anything, it appears to be about to gain a new life.

Next, they worry that another shoe could drop regarding questions related to Biden’s son Hunter and his business dealings. Lastly, some Democrats are concerned about Biden’s age and possible cognitive issues — a concern that some also have expressed about Trump.

For those reasons, and a few more, might we envision Biden being privately talked into retiring from the race or voluntarily doing so himself? Let’s assume that happens just before or just after the party’s convention, in whatever form it is held. What would happen then?

The process is actually fairly straightforward. If Biden quits the race right before the convention, delegates would select a new nominee. If he drops out right after the convention, members of the Democratic National Committee would pick their replacement candidate.

Who might be in consideration to become the new nominee — and who would be selected as the vice presidential running mate?

The only people talking about Hillary as nominee are conservatives trying to get clicks on their website. I know and have asked several Ds. NONE of them want her anywhere close to the D nomination.

If anything like that should happen, it’s going to end up at the US Supreme Court. They can decide.

It's not going to happen so it will remain nothing but an topic for discussion.

People who write articles like this should spend less time on idiotic scenarios and more time on beating Biden. He's the one Trump will be running against.

Of course he is (if he ever was in the first place).

He just can't be "elected" President again (and as I have posted elsewhere, that really depends on what XXII means by "elected").

By that logic then someone who is 25 years old can't be elected vice-president but could be appointed vice-president.

Two different things.

Someone who is 25 is INELIGIBLE to the office of President, and therefore is also INELIGIBLE to the office of Vice President.

But the XXII Amendment does not make anyone ineligible to anything.

What it tries to do is to read 1944 Electoral College appointment practices into the Constitution.

The Constitution doesn't say anything about "running". It also doesn't say anything about political parties, primaries, nominations, conventions, being on the ballot or even the existence of ballots, Presidential elections (except for the electoral college, about which it says a lot). It says nothing about "calling states". It says nothing about "conceding" or "claiming victory".

All of those things are outside of the Constitutional process, are unnecessary for choice of a President, and do not bear on the XII Amendment's criteria of eligibility.

The XX Amendment says NOTHING about eligibility to the office. It says he can’t be ELECTED to the office of President. It says it twice. It does not mention the Vice Presidency - at all.

Do you mean the 22nd amendment?

No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.

Why are you taking each amendment in isolation and acting as if nothing else in the Constitution exists?

The 22nd amendment says the President cannot be elected more than twice. The 12th amendment says the eligibility for President also applies to the Vice-President. Therefore, nobody elected twice as President can be Vice-President.

If we're going to play your game, then we should ignore Article 2 because the 22nd amendment only says the President can't be elected more than twice. Therefore, anyone of any age, residency, and citizenship can run for President because the 22nd amendment says nothing about that, only the number of times elected.

It would be a question for the Supreme Court.

What exactly does “Elected” mean?

There's the loophole. It does not say not allowed to SERVE in the office.

So is someone who has served two terms.

But the XXII Amendment does not make anyone ineligible to anything.

But the 12th Amendment does: "But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States." Obama is constitutionally ineligible to be elected president, he cannot constitutionally be eligible to be elected vice-president.

Textually, the 22nd Amendment does not prohibit a two-term president from being elected VP and later becoming president because of death, resignation or removal. But Obama is done with politics, and he won’t be running for VP.

It’s fairly clear that the Electors meeting in the Electoral College to cast ballots are “Electing” the President & VP.

It’s not so clear whether the House, when “choosing ... by ballot”, is “Electing” the President.
