Yes, but it is still allowed for Covid-19 treatment on an off label basis.

Otherwise, Dr. Vladimir Zelenko would not be able to treat his over 800 patients with it.

There is also a Long Island, NY Doctor, Mhhammud Alam, who uses HCQ for his patients with success. See here:

I Believe he mentioned in a recent interview with Rudy Giuliani that he was forced to suspend prescribing hydroxychloroquine for COVID-19 patients. Prior to Cuomo’s executive order he was able to work around this.
