Decision came from Ferdinand F. Fernandez, William A. Fletcher,and Richard A. Paez, Circuit Judges - two are Clinton appointees the other Reagan. They are allowing more time is all, not a final decision. Maybe they realized that an en-banke review by the entire 9th circuit court would reverse their first order anyway.
