Based on recent FISA court ruling, I believe the DOJ lawyers hope that the whole Flynn prosecution is declared “fruit from a poison tree” and the case dismissed. The DOJ will state that now don’t have to provide any more information to the defense as it would be moot.

Judge Sullivan is an odd duck. I don't think anyone knows what he is going to rule. At some points in the proceedings he's been very hard on Flynn. At other times he's seemed hard on the Prosecution.

It sure looks from the outside like the DOJ's case is discredited, but here we are. The judge has been able to see that for months, but he hasn't done anything to help the defense in that time.

In fact, sort of the opposite.

Was the Flynn prosecution at all based on FISA ? (not disagreeing w/ you, but I don’t know.)
