How far over the line of sedition and treason does one have to go, before being prosecuted? I guess we’ll find out, because the Dems are going to keep pushing the boundaries, until someone gets their neck stretched.

I say some deterrence is needed, just as with terrorism, a strong stand, and punishment that meets the crime should be rendered, asap. Otherwise, this republic is doomed.

What a balless wonders to advocate treason from the safety of his legislative immunity to those actively covered by the UCMJ.

Legislative immunity only covers speeches given on the House floor. Otherwise, it is open season on seditious scumbags, and there's no bag limits.

Yes. According to Seth Moulton’s Wikipedia entry his Bronze Start had the ‘V’ for valor.

I wouldn’t criticize the congressman’s service. I’ll just say that as a junior officer — and Moulton was only a captain by the time he got out in 2008 — you don’t get to question the political wisdom of orders from above. An ‘unlawful’ order is a whole other thing and Congressman Moulton ought to know better than to treat them as equivalents.

Interesting. Back in the mid-80’s, I was flying A-10’s in Germany. Was hanging around the Sembach O’Club bar and a Ramstein JAG joined us and told us he just finished a case where a former enlisted (retired) was discovered to have embezzle thousand’s of dollars from the Sembach Club and then was moved to run the Ramstein Club and did the same thing. He was recalled and prosecuted.

Maybe things changed since then. But consider, if the military can’t recall a retired or former serving enlisted guy that committed a crime, then all an enlisted guy has to do is commit a crime, retire and not worry about being recalled to face punishment for crimes committed while on active duty. Of course, it would have to be a significant crime (as in this case. . .nearly a half-million over, I think he said, about 7-yrs. He ran the Sembach Club then the Ramstein Club. . .

Actually, it is beaten into your head that you do NOT follow illegal orders.

Refusing an order is a serious charge, so you have to be right.

But back to the original point: you receive an order that says shoot every child in a school. That is not legal and you are subject to prosecution if you shoot them.

Just War (St Thomas Aquinas) and Just and Unjust War (Walzer) are two excellent books that explain the morality of killing non-combatants. It all comes down to proportionality, double-effect and a few other qualifiers.
