But is there 51 votes?
*********************
They need 67 votes to change the Senate rules to allow this..so not going to happen. This is simply posturing by some Senators

Senate rules can be changed by a simple majority vote.

You’re thinking of legislation to clear a filibuster which only requires 60 votes.

Maybe.

According to the Supreme Court’s ruling in United States v. Ballin (1892), Senate rules can be changed by a simple majority vote. Nevertheless, under current Senate rules, a rule change could itself be filibustered, requiring two-thirds of senators who are present and voting to end debate.

First, there are enough grandstanding assholes like Romney to put a simple majority in question, and second, Mitch might not exercise the nuke option to kill the filibuster.

Pretty sure this is a 51 vote deal.

No. They need 51 to change the rules. That is how they are getting judges through now. They changed to rule to prohibit filibustering judges.
