Levin: Pelosi’s unilaterally sitting on the impeachment. This is another brazen unconstitutional act...

Nancy Pelosi was apparently advised by leftwing Harvard law professor Lawrence Tribe to delay sending the impeachment to the Senate. So she’s unilaterally sitting on the impeachment. This is another brazen unconstitutional act.

Here’s what Mitch McConnell and the Senate Republicans must do in response: The Senate has the sole power under the Constitution to adjudicate an impeachment. Therefore, Pelosi is attempting to obstruct the Senate’s power to act on its constitutional authority. McConnell should immediately put an end to this and declare the impeachment null and void as the speaker has failed to complete the impeachment process by timely sending it to the Senate for adjudication. McConnell has no less authority to unilaterally make such a decision than Pelosi does to withhold the administrative notification of an impeachment to the Senate either indefinitely or with conditions. Her effort to cripple the presidency and blackmail the Senate must be defeated.

“Doesn’t everyone think this is a crazy moved by the democrats?”

It should have been expected by all. Perfectly logical from the Dem’s twisted point of view.

This is the end of the greatest political hustle in our history.

Once the Senate gets the articles, they can shred them for what they are, nonsense. For all the voters to see. The Dems would be fully exposed in their hate of Trump.

And then........worst of all for the Dems....an acquittal.

Along the way, if Rudi comes up with legit crimes from the Bidens that gets tossed in for the media to ruminate about.

Also, by playing keep-away, the Dems get what they need most, time to manuever and shape the battlefield.

This is a brilliant but warped move to keep the Dems relevant while they stumble towards finding a nominee.

Whom ever did believe that there would be a conviction? With Pence becoming President and just enough time to win the next election? Pence would gather all the Rep revenge votes and all the Independents’ sympathy votes.

I believe that Pelosi and Schiff had this hustle planned from the beginning.

"Supreme Court will say this is a political question and a separation of powers issue and they have absolutely no constitutional authority to get involved."

I'm not convinced that this is true. The Supreme Court might dismiss the appeal like that; however it might opt for truth, i.e. the Constitution does not allow for and therefore disallows impeachment for purely political purposes, in fact stating exactly what constitutes an impeachable offense, viz. treason, bribery, high crimes and misdemeanors.

The Constitution and thus US law state that these are the only lawful reasons for impeachment, thus nullifying this unconstitutional "impeachment."

The Supreme Court should also recognize the coup d'état attempt for what it is and take measures, such as making it clear that impeachment for purely arbitrary and/or political purposes is unconstitutional and illegal. This will prevent similar coups d'état in the future, strengthen the Republic, and strengthen the separation of powers.

The Supreme Court has take similar radical action before, e.g. Brown v. Board of Education and outlawing the Democratic White Primary.

The present attempt at coup d'état is at least as important.

The Supreme Court should accept its responsibility and act accordingly.

President Trump, his lawyers, and the Senate and House Republicans should insist that it do so.

So basically the House took a censure vote, but they get to label it as impeachment.

Interesting press briefing (??) she held. She shut down all the questions about withholding the Articles from the Senate. except for a couple. Today she doesn’t want to talk about impeachment. She wanted to talk about what’s important; those things that didn’t matter to the dems for the past 3 years and the bills the House has passed that the Senate hasn’t gotten to. Impeachment was old news.

I didn’t know it was possible for her to look any worse than she usually does but she sure did today. Poor old bitty doesn’t have a clue how pathetic she is!

"then they die with this session of Congress."

I keep reading that, but is it true? It's not stipulated in the Constitution. If it's in US Code, when does this session end?

The Speedy Trial Clause of the Sixth Amendment to the United States Constitution provides that “[i]n all criminal prosecutions, the accused shall enjoy the right to a speedy trial”
The Clause protects the defendant from delay between the presentation of the indictment or similar charging instrument and the beginning of trial.

I would pose that impeachment includes all of the elements which includes sending the articles to the Senate. Without doing so there is no impeachment.

This session of Congress ends in. Jan 2021 when a new House is brought in by the next election. The Senate is a continuing body as it always has 2/3 that remain.

A reporter on FNC just said the House can keep the articles of impeachment from the Senate indefinitely. Pelosi is a Fool.

The House takes their case to SCOTUS arguing the Senate can’t do that without them “sending” the articles over.

SCOTUS is then going to do what? Go against what they just opined...say it’s now not political and takes up the House’s argument?

As long as this coup is happening, let’s go to war...get all the dirty political laundry out in the open for all to see.

"The Supreme Court should accept its responsibility and act accordingly."

Had they done so, we never would have had a "President" Barak Hussein Obama as he never was a "natural born Citizen" (styled exactly as John Jay's letter to Washington prior to the requirement changing from simply "citizen") as clearly mandated by the Constitution.

The guy even admitted on his campaign website that his birth status was governed by a foreign power....he inherited his foreign father's foreign citizenship by birthright regardless of his actual place of birth. Ironically, one of the rare truths the bassturd ever told in public.

The court threw out all challenges, effectively saying it was a political question.

They shouldn't have done it...but did.

“except in cases of impeachment.”
That doesn’t mean if the president is impeached
that he can’t pardon. It means if anyone is
impeached, they can’t be pardoned by the
president.
