The United States government would be prohibited from asking job applicants about their criminal history at the start of the hiring process under a bill that could become law this week, in a move that would lower a barrier for ex-offenders seeking work.
The legislation is tucked into a defense bill that cleared a procedural hurdle by a vote of 76-6 in the Senate on Monday, setting up a vote on final passage. President Donald Trump is expected to sign it into law as soon as the end of the week.
Known as the Fair Chance Act, the measure is a top priority for criminal justice advocates, who say it will prevent federal agencies and contractors from automatically disqualifying ex-offenders from employment before they can even be interviewed.
In the middle of impeachment, Congress and the White House can still come together to pass criminal justice reform, Inimai Chettiar, the legislative and policy director for the Justice Action Network, said in an interview.
Federal agencies and contractors would be able to ask about criminal records later in the hiring process.
Versions of the legislation, known as ban-the-box laws, have been adopted by 35 states and the District of Columbia.

So, the business owner/employer doesn’t have the right to know if a prospect is a thief, robber, murderer, drug dealer?

I would hope fed agencies and contractors would HAVE to ask about criminal records. not “would be able to”.
I can understand non-violent offenders who have served their time AND reformed, should be able to work. But sex offenders, violent or habitual criminals, and those who do not have a track record of having reformed, should be watched carefully and should only be allowed certain kinds of employment.
Return to crime?
On the other hand, there are jobs one would not want a criminal to have.
If the major crime one had committed was beating a child molester to death in prison, that might be just the guy I want watching my kids.
Our family business hires some people with criminal records depending on what they did. Its our call to make.
Not the government’s call.

By whom?
Trump is releasing hundreds of federal prisoners every month through the First Step Act.
Since almost all federal convicts plead guilty to a reduced charge, we have no idea what crimes they actually committed.

Every hiring authority gets to look at past employment and addresses, frequency of job changes, etc.
I wound up hiring 2 former felons (drugs; sales and use), they both had rehabilitated while in the joint and turned out to be outstanding employees.
No ex-felon should ever work.
Just as a matter of reference, yes we had mandatory drug testing every month.
Up to and including Supervisors and Directors.
How would you have them support themselves?
Robbery and Murder?
What are they supposed to do? Just return to crime?
Nope.
Nothing is stopping anyone from starting their own business. You can start one with $100.
What could possibly go wrong?
