Former White House Deputy Assistant Fred Fleitz took a victory lap on Chris Cuomo after the CNN anchor was “pretty hard” on his contention that California Democratic Rep. Adam Schiff likely knew about the whistleblower complaint before it was filed.

Fleitz made his argument on Tuesday night’s “Cuomo Prime Time,” receiving considerable pushback from Cuomo.

Drawing on his own experience with whistleblower complaints, Fleitz told Cuomo he thought this one “was very unusual.”

When I saw this one, I thought it was very unusual, not just that it was extremely well written, but it had legal references and footnotes. That was a little bit unusual, but I compared that with the fact that Adam Schiff was talking about the subject matter of this complaint throughout the month of August. He posted a tweet at the end of August that almost identically reflected this complaint.

“But you don’t know any of that,” Cuomo pushed back. “You’re raising it as questions. You know that is meaningless unless you can put some meat on the bones. Of course the Republicans are agreeing with you. That’s the whole state of play. Anything you say that’s negative about this guy or this woman they’re going to pick up on.”

I heard this afternoon on WOAI Radio that Schiff has had his “whistleblower” report since mid-July or “at the latest in early August”.
(Sounds like the same “dirty DIMocRAT tricks” starting again, as were used W/O success against Justice Kavanaugh.)

American Show Trial
Nancy Pelosi has evaded the traditions of the house by depriving the minority of the right to subpoena witnesses etc. she accomplish this by declining to put the matter of impeachment to the vote of the whole House and simply declared on her own authority that an impeachment "inquiry" could proceed.

The committees that will proceed include the House Intelligence Committee chaired by Democrat Adam Schiff. The New York Times has reported that Adam Schiff spoke to the alleged whistleblower before he filed his/her complaint and other sources report that Schiff, or a member of his staff, advised the whistleblower about how to proceed and what to incorporate in the complaint.

It is also possible that Schiff or members of his staff coordinated with the Inspector General to modify the requirements permitting a hearsay complaint to be received and forwarded to the House of Representatives. The details or truth of these allegations are not yet known as they play out in the press. But if true, the implications are frightening for any patriot who treasures the rule of law and due process.

Why is this a show trial?

Wikipedia describes show trials as follows:

The defendants of these were Old Bolshevik party leaders and top officials of the Soviet secret police. Most defendants were charged under Article 58 of the RSFSR Penal Code with conspiring with the western powers to assassinate Stalin and other Soviet leaders, dismember the Soviet Union, and restore capitalism.

We have here a president and now his Attorney General and his Secretary of State together with his private attorney alleged to have committed misdeeds and even crimes qualifying for impeachment. The target is the same as a Soviet show trial, the "leader and top officials". The charges remarkably similar, "conspiring with (foreign) powers."

But the Schiff committee parallels show trials in other procedural respects. Because the minority Republicans have been deprived of the power to subpoena witnesses etc. there is no effective opposition to the will of the majority. Majority subpoenas cannot be stopped by the minority on the committee, and may or may not be blocked by the courts. The president himself has no counsel present and, irony of ironies, Schiff has declared that any failure to produce witnesses or documents will be assumed as evidence of guilt. Thus, the president will be deprived in committee and more broadly, politically, in a proceeding that is becoming a transparently political process from declaring executive privilege.

Worse, because Adam Schiff acts as both prosecutor and judge due process is fatally corrupted. Still worse, Adam Schiff has not only conflated the roles of prosecutor and judge but he has also become the advocate for the whistleblower. Finally, because Schiff has a clear personal and political interest in effecting the impeachment of the president of the United States, he is also a litigant, a person who will personally benefit from his actions as prosecutor, judge, advocate/attorney for the whistleblower.

All the while the Republicans on the committee can expect only their five minutes but the president can expect no due process and no justice.

Fredo demands proof but he believes any charges against Trump regardless of the weakness of the evidence.

The headline is completely misleading. Cuomo ate no crow. None. Eating crow means to admit one’s failure. Eating crow means admitting one was wrong. He has not done that. Will not do that. Dems do not eat crow.
