I agree. They overcharged her. Unless, that is, they can show that she knew the man. Better, if she'd been to the apartment before.
Anyway, she will almost certainly go free since it is a murder charge. Her defense is already saying that her cop instincts kicked in when she saw a large strange man inside what she thought was her apartment, and when he started to (allegedly) approach she shot him. Maybe mention how he refused to stop when commanded (even though most of us wouldnt stop if someone came to our house), and there has even been mention of marijuana. Good thing they didnt say it was coke or spice from the mines of Dune or Bulgarian child prostitutes ...
Anyway, the murder charge will be poked full of holes, and the lady will be acquitted.
What is most ironic is this - had any of us walked into the wrong house and shot someone dead, we would be in a LOT of trouble. So much trouble a name hasnt been created for it yet. Shes fortunate she is a police officer.
