Kirsten Gillibrand Drops Out of Democratic Presidential Race

Senator Kirsten Gillibrand of New York, who presented herself in the presidential race as a champion of women and families, said Wednesday that she was withdrawing from the Democratic primary after failing to qualify for a third debate next month — a development she described as fatal to her candidacy.

Ms. Gillibrand said in an interview that she would endorse another candidate in the primary but had not yet picked a favorite. Though she stopped short of saying she would endorse a woman, Ms. Gillibrand, who has made electing women to Congress a personal cause, said the next president had to be capable of uniting the country and suggested that a woman might be best suited for the job.

“I think that women have a unique ability to bring people together and heal this country,” Ms. Gillibrand said, adding, “I think a woman nominee would be inspiring and exciting.”

Ms. Gillibrand, 52, had anchored her candidacy in issues of women’s equality, with a strong emphasis on abortion rights. She pledged to screen nominees for judgeships based on their support for the Roe v. Wade decision legalizing abortion, and held rallies in two Republican-leaning states, Georgia and Missouri, where conservative lawmakers recently passed new restrictions on the procedure.

FR: Never Accept the Premise of Your Opponent’s Argument

Patriots, first consider that post-17th Amendment ratification Sen. Gillibrand unsurprisingly doesn’t seem to understand the following. The 12th Amendment doesn't stop a person from running for president just because they cannot satisfy the debate qualifications of a rogue, constitutionally undefined political party.

In fact, the Democratic Party being able to make her name off-limits to electors in all states is arguably a violation of the Founding States’ prohibition of agreements and compacts between the states without consent of Congress.

"Article I, Section 10, Clause 3: No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State [emphasis added], or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay."

On the other hand, with respect to her leadership goals to be a champion for women and families, Gillibrand actually needs to get out of federal politics and try to get elected as a state government leader, the same for her remaining, likewise misguided Democratic presidential race colleagues.

This is because state governments uniquely have the 10th Amendment power to experiment with social domestic policies that federal Democratic candidates for POTUS are wrongly promising to low-information voters with no express federal constitutional powers to justify such promises, not even as POTUS.

In fact, the congressional record shows that Rep. John Bingham, a constitutional lawmaker, had clarified that the Founding States had given the states, not the feds, the lion’s share of government power to care for the people.

”... the care of the property, the liberty, and the life of the citizen, under the solemn sanction of an oath imposed by your Federal Constitution, is in the States, and not in the Federal Government [emphases added].” —Rep. John Bingham, Congressional Globe, 1866. (See about middle of 3rd column.)


Justice Brandeis had reflected on Bingham’s words when he likewise emphasized state power to serve the people.

"It is one of the happy incidents of the federal system that a single courageous State may, if its citizens choose [emphasis added], serve as a laboratory; and try novel social and economic experiments without risk to the rest of the country.” — Justice Brandeis, Laboratories of democracy.

Note that constitutional limits on states as laboratories of democracy is that states cannot establish privileged / protected classes or abridge constitutionally enumerated rights, and must maintain a constitutionally guaranteed republican form of government.
