The Constitution does not expressly give the government that authority. Thus it does not have that (legal) authority. Your Constitutional argument is backwards.

The federal government has the right to regulate interstate commerce, which includes the right to regulate or to not regulate.
The states, having general police powers, has that same right.
Is that more clear for you?

No you don't get it. Every law passed by a state or the Congress is considered Constitutional until proven otherwise. Laws are not subject to SCOTUS review prior to being enacted. That is NOT a requirement.
In the case of the min wage laws many have felt like you they were unconstitutional and ALL lost their cases.
Where did you grow up Iceland?
