Yep—the charge should have been short of first-degree murder, there was no evidence of premeditation.
Manslaughter is about all you could actually make a case for, and even that would be a tough sell if this case were under any other circumstances.
That’s the way I’ve always looked at it also - how could it be called MURDER?
