James Fields Sentenced to Life in Prison for Death of Heather Heyer in Charlottesville
The New York Times ^ | June 28, 2019 | Mitch Smith

Posted on 06/28/2019 1:26:19 PM PDT by FewsOrange

James Fields Jr., the white supremacist who murdered a woman two summers ago when he steered a Dodge Challenger into a crowd of peaceful demonstrators in Charlottesville, Va., was sentenced Friday to life in federal prison.

Lawyers for Mr. Fields, 22, had pleaded for mercy, citing his difficult childhood and mental health problems. Prosecutors had sought the life sentence, arguing that Mr. Fields’s racist, anti-Semitic beliefs motivated the decision to attend the white supremacist rally in Charlottesville and to attack counterprotesters, killing Heather Heyer and injuring dozens of others.

“The defendant’s crimes were so horrendous — and the maiming of innocents so severe — that they outweigh any factors the defendant may argue form a basis for leniency,” federal prosecutors told the judge in a sentencing memo. “This is particularly true in light of the fact that he has demonstrated that he feels no remorse for his actions and continues to espouse his hateful ideology.”

...

Mr. Fields was convicted separately in state court of first-degree murder in December, and jurors recommended a life sentence. A judge will decide in the coming weeks whether to accept that recommendation.

Center photo. Notice the break lights and an aggressive swerve to avoid the antifa protestor.

I hear ya. He needs some good lawyers to win this on appeal. He clearly had 3rd rate ones for this case.

He deliberately drove his car into the crowd.

I hear that from one side, and I hear from another that he ran into the back of a vehicle.

Even if he did in fact deliberately ran his vehicle into a crowd, is this the norm to charge someone with "first degree" murder for doing this?

I don’t see any swerve. As for the brakes, the guy may have had some internal conflict or it may have been a reflex. People in road rage incidents can have different intentions in their mind at the same time. It’s possible that he could have tried to bargain for a lower charge, but the statements he made earlier and the guilty plea do support the conclusion that doing harm was his intention.

“Not to mention that his vehicle was being attacked by an armed mob before he accelerated, so this wasn’t some kind of premeditated attack, it was an attempt to escape.”

It’s called “breaking contact”.

Look at the front wheels, they are steering away from the antifa person and the car is leaning like you expect it would. That is an evasive maneuver. In North Carolina, that would be called "exercising due care"

.==============================================================

"Drivers who hit a protester who’s blocking the road couldn’t be sued for injuries if they “exercise due care,” under a bill that passed the N.C. House on Thursday."

https://www.newsobserver.com/news/politics-government/state-politics/article146957349.html

.

Or you could be a dummy and sit in there and get killed. A lot of this was happening at this time frame. Remember?

.

"Anti-Trump, protesters ripped the USA flags from my Jeep, in Portland, Oregon. They smashed the windshield, and beat it with bats, and fire extinguishers, after driving away I was surrounded, and attacked again. A smoke bomb was set off in the Jeep, before finally getting away."

You see what you want to see. A possible slight turn of the wheel isn't exercising due care.

You can find a picture of the car going into the crowd here. No brake light. No sign of a possible swerve.

Apparently in Virginia one need only have the desire to kill for a moment and act on it successfully to be charged with murder.

Ford Fischer, purportedly an Antifa activist who acts like a nuetral observer in his video , just happens to film the car 7 minutes before the incident. He also makes sure he videos the van blocking the streeet before it all happens, too. He obviously knows something by the attention he gives to each of the vehicles in his video beforehand.

Apparently the damage done to Fields car bumper happened after this video and BEFORE the car gets struck again in the incident video. The whole thing should be reinvestigated.

Yep. Not to mention that his vehicle was being attacked by an armed mob before he accelerated, so this wasn’t some kind of premeditated attack, it was an attempt to escape.

I remember that video...They were beating on his car with clubs/bats...Seems he panicked and hit the gas...Rammed the car parked in the middle of the intersection which lunged ahead...Do I remember that correctly???

Either he had an exceptionally bad sense of direction...

Panic will do that.

Being surrounded by a mob of angry people tends to induce panic. People do stupid things when they panic. From the comfort of our keyboards we can all to easily suppose we know what the driver "should have done". That is not a valid expectation.

The driver was a moron to be there in the first place. He was not committing an intentional first-degree murder. The body count would have been much higher if that were the case.

And his guilty plea means not one dammed thing. He was promised leniency in exchange for a guilty plea. It is standard procedure in such matters, and the facts of a case are irrelevant. The promise was also a lie. That too is commonplace. He is a moron with an inexperienced public defender and he believed what he was told.

"Life is hard. It is harder when you are stupid"

The Leftists won big time on this incident. It has encouraged them.

Later this summer, we will probably have a incident where a "mostly peaceful" Antifa protestor deliberately kills several Trump supporters at a rally in a liberal State. No doubt, we will see an astonishing difference the reactions of the media and the "Justice" system in that State.

No, I didn’t see a video of him striking the woman. The videos were of him driving into the crowd with his car fully intact and undamaged.

He pled guilty to so called “federal hate crimes”. His only attorney— a public defender (who wants to find work after this trial). This was a trade deal as positioned by the prosecutor (who is running for office— what party do you think?) so he would not get executed- and instead got life in prison. Under any other scenario— this kind of individual would be sentenced to vehicular manslaughter. The individual who had blunt force cardiac contusion was hit by a maroon van which had been hit by the toyota behind it. The car speed, as set in the Hunton& Williams consultants hired by the city and VSP... was clocked (by aviation) at 17mph. Into not one but two vehicles both with brakes on and in Park. In addition, the CVille police, and county sheriff’s unit, too an officer off 4th Street location and the barricade was removed (by antifa.. btw) and the two vehicles allowed down 4th street into another intersection where they parked. The officer was not replaced, and the watch commander did not know she had left her post to replace her. Therefore— culpability in the presence of ANY vehicle on 4th street, including this moron, falls heavily on the piss poor police presence. No cars, not his...., no mob attacking his vehicle— and no collision at any speed.

As to the coroner’s report, am requesting for professional review. The chemistry and post mortem needed for a COD as “contusion” is very specific. The individual had multiple concurrent health issues.

Hate crimes... thought crimes... stated wishful thinking thought crimes expressed on social media, as legal evidence- w/out regard to validating that the individual actually did the posting. Orwellian— the concept of a “thought crime” as evidence to support a more serious charge. Without the political element and the unfathomable concept of a “hate” crime (since murder would typically involve— mental anger/anger passion-resolution at the time of the crime or.. amoral dispassion during any murder or violence committed warranting a forensic psychiatric diagnosis- neither of which can be proven without a confession. Not yet anyway, or not without truth agents that are not allowed to be used).

Again, will be very interested to see the clinical report from the coroner. And just whom that coroner is (never forget the clinton arkancide coroners).

What if it had been an AntiFA who had rammed.. anyone? The overall Hunton & Williams report lays much of the blame for the altercation and violence on absolutely poor police actions— embarrassingly so(perhaps coordinated by the city and state/Gov. McAulliffe, however not the sheriff. AntiFA did not have a permit to be there, yet was known to be organizing to do so) by insure the parties would be in close proximity, having not planned at all for a large group of communist AntiFA. The full report is well worth a thorough read.

Troubled individual, seriously stupid guy, and now will join his compadres- and will need to, in prison.

The photo of the individual in the Challenger is of a guy with a green shirt on. It’s photoshopped by some conspiracy whack job. In addition— too much beard and of the wrong type of beard. The guy had a fat face and a heavy stubble and wearing automatic sunglasses prescription glasses.

Am looking to find the actual photo taken of the driver— not this one.

Fields was wearing a white polo shirt (a lot of the non-antiFA was— for recognition of their group members).

OK, the top sheet to the coroner’s report, done by a youthful asst. medical examiner— shows COD as being “blunt force to the torso”.

Not specifically as reported in the news last few days as
cardiac contusion from blunt force— meaning a heart attack caused by blunt force to the heart (through the upper breastbone/rib cage). The full autopsy needs to be re-viewed. As well as the entire trial transcript and evidence... all of it.

Yes, just before he accelerated some thug armed with a two-by-four or something was doing his best to smash in the rear window of the car.
