For me, it is BAD NEWS. The Supreme Court ( unlike say, Roe v. Wade or Obergfell v. Hodges ) made a cowardly decision not to tackle an issue that affects the FUNDAMENTAL RIGHTS of every American, ensuring further future lawsuits, instead of settling the issue once and for all.
The court punted and kicked it back for review by the lower court.
The court sent it back down for review based on Masterpiece Cakeshop v. Colorado Civil Rights Commission.
BAD, THEY CAN KEEP SUING CHRISIANS WHO STAND UP OUT OF BUSINESS.
They’re sending the case back to be decided on by the same court which showed extreme animus toward the baker’s religious beliefs.
That’s like letting the fox decide if he should be let into the hen house.
I recall hearing (from Jay Sekulow, perhaps?) that when the Supreme Court does this, it is a clear signal to the lower court that they got it wrong and need to reconsider. Whether the lower court will play it smart or double down on stupid, of course, is another matter. Left-wing states tend towards the latter.
