The Southern District of MS has 6 seats. 1 Reagan, 2 GWB, 1 barky, 1 recent vacancy, and 1 vacant for over a year.

2 questions:
1) Why does the lone barky judge get the case?
2) Why is a seat in a solidly Conservative state vacant for over a year? (Hello Cocaine Mitch! Please pick up the courtesy phone!)

Good question but I wouldn’t expect the judge’s ruling to survive en banc review, the 5th circuit is solid Republican.

The Senate has not yet received the name of a nominee for those two vacancies from the President. Perhaps the President is waiting until Mitch and Lindsay move faster and reduce the backlog of current judicial nominees pending in the Senate.

There are currently 137 Federal Judge vacancies. There were 112 vacancies when Trump assumed office. McConnell and Graham have been doing a good job in filling Appeals Court vacancies but they are doing a CRAPPY job of confirming District Court vacancies. SPEED IT UP!
