When Jefferson died it was illegal to emancipate slaves who would stay in the state. So she was not freed.
Jefferson freed Sally’s children in his will but not Sally. One of them, Madison Hemmings, was living in Ohio at the time of the 1870 census. The census taker wrote a note in the margin: “This man is the son of Thomas Jefferson.” Some of her descendants were able to pass for white.
She lived out her life as a free person of color in nearby Charlottesville and, out of respect for Jefferson, she was left alone when she could have been sold as part of the estate to pay down Jefferson's debt.
