Majority leader says technology, more personnel at border would be more effective than barrier
House Majority Leader Steny H. Hoyer said Democratic leadership has not yet discussed what their reaction would be if President Donald Trump were to follow through on his threat to declare a national emergency on the border to build his wall, but he said a lawsuit is certainly a possibility.
Hoyer reiterated Democrats opposition to a border wall and said theyre not really interested in alternative barriers either. He said experts have said neither a wall nor fencing is whats really needed at the border but rather technology, drones and more personnel. Democrats and Republicans remain at an impasse over border security funding and seem unlikely to reach a compromise soon to reopen the government, which has been partially shut down now for 18 days.

Grow up. The Trump Administration would not defy a court order.
I’m not sure the judges have the same standing with an NE order as opposed to an EO. Are judges not neutered under a NE? If aliens land on the WH lawn and the president issues a NE order, what judge would have standing to challenge that?

Just as a point of fact: there are only 9 depts./agencies affected. Staffed with 85% ‘non essential’ personnel. (which should provide an opportunity now to cut that nonE staffing by 50-80% or eliminate the depts. all together but that’s another thread)

Trump has the authority to issue a National Emergency Order under the National Emergencies Act, which is a law like any other, and spells out what is and is not a "National Emergency."
Interpreting the law is what courts are for. And if you read the statutes, there is a lot more wiggle room for the bad guys to argue that a state of emergency does not exist, than there was for the Travel Ban, and we lost the Travel Ban argument right up until the Supreme Court's 5-4 decision.
So yes, the courts would have standing to block any declaration of National Emergency until the argument of whether a state of National Emergency existed was fully played out in the courts.
You never know.
The question that should be asked is how much does it cost America in welfare, lawlessness and drug deaths if the pipeline remains open?
The great share of illegal drugs are brought in by vehicles that run over areas of the border across desert land. A barrier would stop such vehicles.

Stop lying to the American people. If those techniques were more effective, you would not recommend them.
If the pipeline remains open, the cost will be the future of the country. Conservatives and the GOP are being buried by an endless wave of invaders who will be mainlined to vote for Democrats forever. Soon the demographics will assure that the Left will takeover with nothing more than a token GOP opposition on a national level. Then, the real oppression of all of us who are wrong thinkers will begin.
Who cares. Ignore the courts.
