Being Reported:

Judge Kelly is referencing a previous case, which he says did set a precedent where a journalist’s fifth amendment right to due process would apply to a case like this.

Kelly agreed with the White House that there is no First Amendment right to be on the White House grounds, but added that Acosta did not receive due process before his pass was revoked.

Judge agrees with the White House that there is no first amendment right to come onto the White House grounds. HOWEVER once they do open up WH grounds to reporters but denies others, first amendment comes into play.

Judge Kelly further explained that Trump is not required to call on Acosta at press events but that Acosta’s First Amendment rights are more important than the White House being able to have orderly press conferences.

Judge Kelly says Trump need not ever call on Jim Acosta again, but Acosta is owed due process if his hard pass is going to be revoked.

Kelly says plaintiffs have shown likelihood fifth amendment rights were violated, and there is irreparable harm.

The case, however, is not over. Judge Kelly provided temporary relief to CNN, but there will be additional hearings before an official ruling is handed down on whether the White House violated CNN’s First and Fifth Amendment rights.

Ok revoke everyone’s press pass. Simply stop wasting time on this clown show. What are they going to do?

Why they cry about it, tell them to take it up with CNN and Acosta

This is nuts. So anybody can just get press credentials, go to a WH press briefing, and start yelling questions at the President? Otherwise the WH is violating a person’s first and fifth amendment rights?

Acosta’s First Amendment rights

And that right there is where the Judge violated his oath of office and exposed himself a poltical clown not a Judge.

There is no such right in the 1st Amendment for special treatment because one is a “journalist”.

I think President Trump should just quit holding formal press conferences until CNN withdraws Acosta.

No due process?

How much due process is there when a judge controls his court room?

Like with contempt, where a judge is a direct witness to the events, the people deciding to boot Acosta have direct access to the evidence.

Due process assumes a right is in question of being taken away.

A WH press pass is a privilege, not a right.

This is one stupid judge, or a compromised one.

This is craziness, because if it is applied consistently it means nothing less than every “reporter” in the country must be allowed into WH press briefings. If the WH doesn’t have enough control over the WH to decide who has a press pass (the judge is clearly violating the Constitution’s separation of powers here), then everyone must be allowed to have one.
