Failing to sue would be to fail to correct a serious problem for the rest of the people of the U.S.A. It would be far more appropriate and honorable to sue.

If he is not appointed to the court, he really has no option but to sue her
He is a sitting federal judge. The feminazies will demand Congress impeach him if he is not fit to be on the SC he is not fit to sit on a federal bench
Which is why in order for her to tell her story her lawyers demand she not give testimony under oath
