Kavanaugh knows he would lose the case. K. would have to prove that Ford knew that her claim was false, and that she made it with intent to harm him. Even if solid proof emerges that the incident didn’t happen, or that K was not the culprit, Ford can claim she truly believed it/repressed memory, oops. Next, her claim was made in a private letter with a request for confidentiality. She can say she wasn’t the one who promulgated it — Congresswoman Ewok and Sen Feinstein did; sue them. Then she can claim that she had no intent to harm K., just doing her duty to inform the Senate.
All of this, plus her detail-free allegations, is a tell that lawyers directed her hoax from the get go. Building in layers of defense before the fact is a Clinton fingerprint. Senate should question her on all her contacts with attorneys (naming names, dates, times, correspondence, subject matter, etc.), officially representing her or just giving “free advice”, directly or indirectly, for the last 7 years.
