While I disagree with Facebook’s position, it is a private business.

Facebook, Twitter, Youtube, and the rest consider themselves "platforms" and as such, are not liable for content under the DMCA. They want the freedom from liabilities afforded platforms (the same freedom that cell phone providers enjoy) but they want to behave as publishers and censor otherwise legal content they disapprove of.

They can't have it both ways. One or the other.
