The Church does not go by what is and what is not in the Holy Scripture; the Holy Scripture is itself the product of the Catholic Church.

Not for the Roman Catholic....the RCC only dogmatically approved their canon at Trent in the 1500s. Prior to that there was no dogmatically approved canon for Rome.

Plus, your argument forgets the OT was around for a pretty good while before Rome showed up on the scene.

Off topic, but so that you know, “dogmatically approving” the canon of scripture does not mean the canon was different before. The Church makes pronouncements like that when something is questioned, not before, when it is a common belief.
