The question is whether the threat posed by the shooting victim rose to the level of threat to life and safety that justified using deadly force. Probably something a jury should decide anyway, if for no other reason than to give prosecutors something to measure the threat by.

Yes, and at the moment he pulled the trigger. It's not what happened before that moment that matters.
