True, however the White guy is past his physical prime and has just been knocked on his ass. I would be significantly less adept and quick at retrieving my holstered firearm after a similar knockdown. Likely he fired as soon as he had a good target, the decision was made when Dindu continued to approach after the battery.

Yes, that's how I'm starting to see it too... The slight pause is likely because the shortly-to-be-deceased IS moving & moves slightly to the side too. At this point fear and getting an accurate shot off is likely about all the shooter's mind can really process, unless the STBD freezes and throws his hands up IMMEDIATELY.

I don't know why, but this vid made me think back to the last time I played softball at a picnic --certainly something I've done before, but also something I'd probably only done half a dozen times in the preceding 20 years. High fly ball coming to me: TOTAL attention is on catching that thing, but even so, I'm not a trained pro and not consciously analyzing which direction the spin will take it, probably not hearing the 2nd baseman screaming "throw to 1st" (to pick off the runner) until after the catch is made, etc. And that's a heck of a lot stressful situation!

That about sums it up, and that is imminent fear of death or great bodily harm, lethal force self defense criteria.
