An argument over a handicapped parking spot at a convenience store in Florida led to a fatal shooting and the man who pulled the trigger wont be arrested under the states stand your ground self-defense law, authorities said.
Pinellas County Sheriff Bob Gualtieri told reporters during a Friday press conference that Thursdays shooting death of Markeis McGlockton, a 28-year-old father of three, is within the bookends of stand your ground and within the bookends of force being justified, the Tampa Bay Times reports.
Im not saying I agree with it, but I dont make that call, Gualtieri told reporters, adding that his agency will now forward the case to the State Attorneys Office for a final decision.

Although I throw out the “racial slurs” as both unimportant and possibly a lie (as the N word has become the only thing that one can get the chopping block for, bar none, it has been so hyped in importance).
Sounds like he might indeed be a self-appointed policeman.
Of course, I do admire some stubborn types who constantly bang the drum which might change things ultimately (as opposed to the do-nothing crowd of cowards), but they can get a bit carried away.

You find out he had a right to that space and it might change the whole context.
Meanwhile, I find out he’s just a do-gooder and it’s a bit different from a handicapped person getting in an argument.
This is a very close case as to whether the shooter committed a crime. First, the “Stand Your Ground Law” stuff is a bunch of crap. SYGround simply eliminated the common law requirement that, if you are outside of your home, you make an attempt to retreat from a confrontation before using deadly force. The shooter was attacked by the deceased and knocked to the ground. Simply put, SYGround laws have nothing to do with this case. The issue in this case is whether the shooter actually feared that he would suffer serious bodily injury or death if he did not shoot. Its a close case: From the shooter’s perspective: a) he was violently attacked; b) the attacker appears to reach in his waistband; c) the girlfriend of the attacker got out of her car and appeared to go towards the shooter on the ground before he shot. I would need to know what the shooter told the cops as to why he shot. Was he disoriented from hitting the ground? Did he think the girlfriend was going to jump him while he was on the ground and that the deceased might come back? From his angle on the ground, did he fear that the deceased might have a gun or weapon? Did the deceased say something like: “I’m coming back to get you”?

Just a general thought here: If the brother man would act civilized, they would not get shot by cops or Mr. Handicap Spot guy. Just sayin’.
I have lots of friends who have concealed carry licenses. In addition to having clean criminal records, their driving records are also continually evaluated. I don’t think DPS would look too kindly on a concealed carry holder who habitually parks in handicapped parking spaces if he gets ticketed. it’s not just felony convictions that DPS looks at.
If I were knocked to the ground by a feral, I'd be worried about any nearby "kickers" ready to join in.

For me that’s the only thing that would make it justified, but the sheriff didn’t mention it.
I won’t make a legal call from behind my keyboard but it appears he made a couple of bad decisions.
If you have your gun drawn and someone advances on you, you have already lost considerable advantage, and your weapon could become their weapon in a split second.
The dead guy caused this result by assaulting someone for no reason.
I have no sympathy for him at all.

The key point is after the gun was drawn, the dude was retreating.
I don’t agree AT ALL. watch the video. He knocked him down and then started to pull his pants up like he was going in again, then saw the gun and hesitated. his bride got out of the car as soon as she saw him come out of the store too like they were both going to go after Drejka. The thug got what he asked for.
What I was taught in a CCW course, that means no immediate lethal threat and no justification to shoot. The guy on the ground just sat up, aimed, and fired. Plain killing, fortunately caught on video so the State's Attorney will have a chance to reconsider. Should she have parked there? Of course not. Is that worth killing somebody? Not in my opinion.
After the initial push that sent the man to the ground, the threat continued because the black guy took at least one more step, more like 2, towards him while he was on the ground. Watch the tape for yourself. In fact, he appears to adjust his shorts which is what he did just prior to the first assault. As if he’s going to do more.
Shooting justified.

they’ve already ruled he acted under SYG. no lawyer needed and the he’s buffered against anyone coming after him legally.
