Well, I trust that he knows what he’s doing, and the end result will probably be to my liking. But, I’m the type that doesn’t care what plays a football team makes, just give me the final score, and I’m done.

I agree with you. I long ago that there’s nothing liberal about the modern Left. Leftists have a hive mentality and nothing but contempt for personal freedom. I’ve heard ANTIFA types make it very clear that they’re not “liberals.”

Ideology killed the right for a long time.

Abortion, for example. Easier to be a champion of adoption than to come out against the holy, sacred, enshrined in the original Ten Commandments right of women to decide whether their children should live or die.

It’s going to bite them again too - whoever you nominate, the answer to the question is ‘Roe v Wade’ is settled.

Any strict constructionalist can answer with a straight face that the least federal control over EVERYTHING NOT IN THE FIRST NINE AMENDMENTS is the best kind of government.

You can also argue that Roe v Wade isn’t the only absolutely ridiculous judicial act committed by the SCOTUS, it’s just one of the latter ones in a long string of them. (you wouldn’t say that at a confirmation hearing, but its true).

You COULD say that judicial activism is an abuse of power, and that judiciating from the bench, for ANY ideology, is undermining the proper functioning of government. Judges everywhere are acting like petty magistrates, and that the practice has to end.

Each branch of government needs to stay in its lane. This is the original and foundational premise of the American Experiment.

Can a situation be foreseen in which overturning it makes sense? No. There is no situation where overturning it makes sense. The only antidote to bad judiciary decisions is better legislative processes. Make better laws. Get rid of bad laws.

Don’t get the judicial process mixed up with secular humanism or atheism.

Judges are there to restrain the legislature from overstepping the boundaries set by the constitution (they’ve done a poor job), not to make law.

Congress makes law. Executive enforces it.

Congress can outlaw abortion. In fact, Utah can outlaw abortion if it wants, and then SCOTUS can decide to hear the case based on different merits.

That’s how DOMA went down the tubes. Remember, that was the law of the land for a brief, shining moment too.

However, that’s not what the SCOTUS does, help invent new ways to help Congress get things done. (yes, they have in the past, which is why we are in this mess.)
