STUNNING: Jeff Sessions Cited the WRONG LAW when He Recused Himself from Russian Witch Hunt Took Advice From Obama Lawyers ( full title )
...
Sessions made the announcement the day after he was sworn in as Attorney General after advice from Obama lawyers in the Department of Justice.
...
legal expert Gregg Jarrett told Sean Hannity that Sessions used the WRONG LAW when announcing his recusal. He took advice from OBAMA OFFICIALS and they misled him.
Gregg Jarrett: He betrayed the president. He knew when he was sworn in that he was going to recuse himself and the very next day he put the recusal in motion. He never told the president about that. And by the way he cited the regulation in his recusal He cited the wrong law. It didnt apply.
Sara Carter: I think he was being advised badly at the time.
Gregg Jarrett: Yeah, by Obamas holdovers. Who in the world would believe them?

My time is just too valuable to be bothered with nonsense.
How goes it with you & yours?
Ted Cruz as his replacement. He wont recuse.
He could have fired Jeff Sessions instantly after the recusal announcement.
Re: “Gregg Jarrett: Yeah, by Obamas holdovers. Who in the world would believe them?”
Donald Trump believed them.
Trump appointed Obama holdover Rod Rosenstein as Deputy Attorney General. Trump could have withdrawn the Rosenstein nomination after the Sessions recusal.
Instead, Trump allowed Rosenstein to be confirmed, and Trump allowed Rosenstein to appoint special prosecutor Robert Mueller.
Trump also appointed four Obama generals...
John Kelly - Chief of Staff
Michael Flynn - NSA
H.R. McMaster - NSA
Mad Dog Mattis - Secretary of Defense

Thanks george76.
It is an open question whether the Vacanices Reform Act applies to situations where the person has been fired by the President. The specific language of the law is “dies, resigns, or is otherwise unable to perform the functions and duties of the office...”
Does being fired mean one is ‘unable to perform the functions and duties’? In one sense, obviously yes, but I think it’s plain to see how any lawyer worth their salt could make a compelling argument otherwise.
Considering how liberal the DC Circuit Court is, it almost certainly plays out like this: Trump fires Sessions, appoints Pruitt citing VRA. Dems run screaming to the court. Uber-liberal justice issues a Stay of some kind on Pruitt’s appointment leaving Rosenstein in charge. Delay, delay, hearing, delay, counter suit, counter motion - three months have passed with Rosenstein at the helm and Bob the Mule still running his dog-and-pony show.
Also, the appointment under the VRA can only last for 210 days, and the person so appointed is not eligible to be appointed to permanent Department head. So if Pruitt has personal ambitions to be AG then he’d likely advise Trump not to take this route. Can’t you just see the ridiculous trial over whether or not the 108 days after Pruitt’s appointment and his actual taking the reins at DOJ due to the court’s stay count against those 210 days?
Regardless
Sessions isn’t recused in any way of going after the Clinton Crime Syndicate. He’s recused from anything to do with the Trump election campaign and its dealings with Russia. If Sessions WANTED to he could launch thousands of investigations into Clinton and Obama.
Anything to with Iran? He could do that. Vote tampering/buying? Ditto. Pederasty? Of course. He is CHOOSING not to do these things, he is not prevented from doing them in any way.
So, ultimately, his fecklessness is worse than you indicate it is. It’s not that he went in as a crippled AG. It’s that he’s in there with all the powers of the AG and is doing spit-all.
Good comments until this:
> “Tillerson worked directly for DJT and he is gone after a very short tenure, so why is Jeff still in his position??”
FR has discussed this to exhaustion. Jeff Magoo is not the man for the job. He is doing only 50% of what they President expects of him. He has several times flubbed his statements to the press and appeared tone deaf to Americans (asset forfeiture, marijuana fixation, Bundy and Hammond prosecutor kisses and hugs).
But the real reason Sessions isn’t sacked yesterday or before he ever started is because there’s an up and coming deep state middle manager with the name of Rosenstein that has been covering for Mueller and others in his previous service with the Obama-Clinton circles. He’s not loyal, he’s compromised, can’t be trusted. And yet, there he is, #2 at DOJ just waiting to move into Magoo’s office.
As pointed out by other wishful thinking contributors on FR, the President could select other persons inside the DOJ and appoint them as acting AG. But the problem is there are many Obama holdovers there, the DOJ personnel roster is suspect after 8 years of Obama/Holder/Jarret.
So Magoo is left in place by default. He’s not great, he’s just preferable to what is available.
As far as firing Magoo and appointing a successor, the Senate is marginally GOP and not always loyal to the President — so no deal for now.

“What difference does it make?”
Sessions didn’t want to be involved.
Obama Lawyers = worst in the world
—
not if you were member/associate of obama/Hillary - then the opposite applies.
Sessions is a SWAMP DWELLER!! They must have something REALY big on him.
PERFECT!!! Which one of the dwarfs is that?
Bttt
yes. It’s all coming together.
Yes, this will be sweet methinks. I’m amazed.
Did you think about that before you posted it? It doesn't appear so.
I think we are past that. Sessions needs to go back to sweet home Alabama. He's already proven that he has very poor judgement. Southern Man don't need him around anyhow.
Note: He could and did delegate his authority but not his responsibility.
Sessions is down there with Neville Chamberlain as the exemplification of fecklessness, incompetence, and downright stupidity.
Lot of truth to that.
The ways of Washington are not easy to decipher....and trying to out-think DJT is foolhardy.
