3 new California immigration laws

The new year will usher in a slew of new laws in California. Here are three immigration-related laws that take effect Jan. 1, 2018

Workplace immigration inspections will be limited.


California is a sanctuary state for illegal aliens but not for employers. The following are the financial penalties that employers are subject to for violating the protections provided for illegal aliens.

AB-450 bans employers from consenting to ICE workplace inspections without a warrant.

Fines I will be subject to as an employer in California

The bill would prescribe penalties for failure to satisfy the prohibitions described above of $2,000 up to $5,000 for a first violation and $5,000 up to $10,000 for each subsequent violation, as defined.

The bill would define affected employee for these purposes. The bill would prescribe penalties for failure to provide the notices of $2,000 up to $5,000 for a first violation and $5,000 up to $10,000 for each subsequent violation, except as specified, to be collected by the Labor Commissioner.

An employer who violates subdivision (a) shall be subject to a civil penalty of two thousand dollars ($2,000) up to five thousand dollars ($5,000) for a first violation and five thousand dollars ($5,000) up to ten thousand dollars ($10,000) for each subsequent violation

An employer who violates subdivision (a) shall be subject to a civil penalty of two thousand dollars ($2,000) up to five thousand dollars ($5,000) for a first violation and five thousand dollars ($5,000) up to ten thousand dollars ($10,000) for each subsequent violation.

An employer who fails to provide the notices required by this section shall be subject to a civil penalty of two thousand dollars ($2,000) up to five thousand dollars ($5,000) for a first violation and five thousand dollars ($5,000) up to ten thousand dollars ($10,000) for each subsequent violation.

(1) Except as provided in paragraph (2), an employer who violates subdivision (a) shall be subject to a civil penalty of up to ten thousand dollars ($10,000).

That’s funny. If you fail to pass a weapons background check the state sends a task force to your hoe to search without a warrant. I’ve always wondered how these work. It may have something to do with if you are a felon or ex-con I think they may be able to do warrantless searches.

If CAL-OSHA shows up, I let them in. Anyone agency without a specific workplace reason to be there is not coming in.

If ICE showed up and said we want to look around, I would not let them look around. I don't need a law for that one.

Being a California employer my experiences with ICE and its predecessors has been a payroll audit. Look at your books, employee name, does name match social security number, if not 30 days are provided to correct (or not) the discrepancy. No more intrusive than the IRS.

Congress needs to pass a law that fines ANY state legislator $250,000 personally, for voting for a law which compels state citizens or businesses to federal immigration laws.

You do understand that this California law is making it illegal to voluntarily cooperate with a federal law enforcement agency, right?

Recall that the Reconquista front went to court in 1996 with the argument that “a state cannot make an immigration law”.

Pfaelzer agreed with that in overturning 187.

All of these laws violate her ruling.

The same people went to court with the same mantra against Arizona over SB1070. The Ninth agreed with the MexiBigots and overruled portions of SB1070.

So now we have de Leon’s outrages as listed, where’s Jeff Sessions and the Republican party?

Absolutely and completely silent.

We escaped SoCal in 2015 for a Red State (Tennessee). When I tell people I came from California, they don’t even bother to ask why we left. They just nod their heads.
