The judge in former Sheriff Joe Arpaio’s now-pardoned criminal case has refused the retired lawman’s request to throw out all rulings in the case, including a blistering decision that explained her reasoning in finding him guilty of a crime.
The request denied Thursday by U.S. District Judge Susan Bolton was aimed at clearing Arpaio’s name and barring the ruling’s use in future court cases as an example of a prior bad act.
Bolton said pardons don’t erase convictions or the facts of cases. She said the pardon issued by President Donald Trump only mooted Arpaio’s possible punishments.
“The pardon undoubtedly spared defendant from any punishment that might otherwise have been imposed,” Bolton wrote. “It did not, however, ‘revise the historical facts’ of this case.”
Arpaio attorney Jack Wilenchik said his client will appeal Thursday’s decision.

The “facts of the case” are that an out of control judge tried to stop an elected official from doing the job he was elected to do; to stop a law enforcement officer from protecting the public.

I can’t think of an example in history where a rotted government was ever repaired by working within the corrupt system.
These termites will never willingly leave their food source, the foundational pillars of our Republic.
We just have to look at history to know how they will leave. It’s just a matter of when.
What is the wording of a Presidential pardon?
I don’t see how it could be used against him since he was exonerated by the highest authority in the land.
Use of the pardon power to say “the court was wrong” is the very basis for the power.
Her ruling is no evidence of anything. So seems the Judiciary should want it expunged for ‘the courts’ dignity’.
“The facts of the case” have absolutely no meaning since there are no legal findings related to those facts. If a person is found innocent they are simply innocent. There are no degrees of innocence.

We’ve long surpassed the rule of law in this country.
Thanks to the Obama’s and the Bushes we now have the rule of tyranny. It’s time to fight back.
A pardon means it never happened.
If there was any justice in America Susan Bolton would be tried before a jury for violating Arpios 6th amendment rights to a jury trial and then hung as a tyrant for her crimes.
She can be impeached by a majority vote of the House. The trial would be held in the Senate, and if 67 senators vote to convict, she would be removed from the bench.
