If he’s a Nigerian native he doesn’t have any constitutional rights.


Might not make sense to you, but in fact he does have Constitutional rights. The Constitution uses the words “person/s” when defining rights in both the 5th and 14 Amendments. (This does not mean his law suit has merit).

Looks as though at least parts of the Bill of Rights apply equally to non-citizens, but I did note that they do not have a right to legal counsel on our dime. The other thorny problem is holding deportees in jail for extended periods of time when their country of origin refuses to repatriate them. I guess that was part of the rationale for Gitmo since it isn’t on US soil.
