I know. You have it in a nutshell. There seems to be no mechanism for a determination on mental competence.
I'm no doctor, but as the friend of a similar patient, his mental capabilities also control his observable physical attributes. His vision, speech, hearing, balance and coordination may suffer. Not so obvious symptoms such as the ability to regulate his body temperature, breathing, other internal functions.
Some were already commenting on the odd speech characteristics in his most recent tirade.
