Congress should simply allow asthma inhalers that can be sold in the EU to be sellable here too.
In fact, Congress should allow almost all EU generics and biosimilars to be sellable in the USA. Congress should require the FDA to make a list of all of the EU approved ones that should be sellable here and then make a second list of the ones the FDA thinks shouldn’t be sold here along with the reason(s) why.
They will not do that. They bet billions from drug makers over here. That is another reason why they are so expensive. Kick backs.
