I suspect that the DOT regulation should be read as "IF the CDL holder wants to keep his license, he must submit to a blood test." I don't think the DOT can over-ride the law on warrants, right to privacy, etc.

Hope so. But in some states the Dept. of Labor can override the law on baking cakes.

And at the time of this incident, the trucker was in a coma, not able to give or withhold consent.
