The incident happened over a month ago. They are only acting now because the video went viral.

Paid vacation while his department tries to spin this. If he is found in the wrong he should be made to paid back the money he got while on this “vacation” because it wasn’t deserved.

The hospital is standing by the nurse, and the police department is backpedaling on the cop’s actions; I suspect she was in the right in terms of procedures.

“What were the cops wanting to find in the blood of a poor trucker who was hit by the sh!thead they were chasing?”

Trucker was injured in a high speed police chase so here’s a possibility he could sue the department.

As a pro-trucker his blood has to be clean after an accident or else he could lose his licence/livelihood.

Were his blood test to be found tainted with drugs/alcohol it could be used to “influence” him not to pursue a lawsuit.

” I don’t think the DOT can over-ride the law on warrants, right to privacy, etc”

Hope so. But in some states the Dept. of Labor can override the law on baking cakes.

Yes, and the juries thought so too.

The claim is that he did, the story is he was in contact with his Lt. and was told to arrest the nurse. His superior might be the other suspended officer...

D.O.T. rules are secondary to the rules regarding the legality of a blood draw as described by the nurse.

If an officer puts a person in custody illegally (and there are rules) then he actually can be charged with kidnapping or false imprisonment.

A prison gaurd once tried to lock me in a cell (auto-door) because he thought I was taking to long with a transferee. I slid out as it was closing. If he had succeeded, it would have been technically kidnapping (or false imprisonment). I could have been rich.

Hospital management are spineless weenies, too. The nurse is standing there talking on her phone to some corporate loser shining a seat with his butt. He should have been down on that hospital floor standing up for his subordinate employee who was just doing her job. I hate corporate weenies.

“I normally support LEO’s but this turkey not only should be fired but charged with assault.”

This is the same kind of cop who gleefully shoot family pets, show up in force at wrong addresses, shoot when you are trying to show ccw, shoot when you don’t “comply” instantly, etc. They are in it for the power trip of lording it over fellow citizens. Country is loaded with them. Reflective of profoundly mediocre politicians.

“But, just as a point of correction, a citizen cannot refuse to comply with LE.”

One certainly can. No one is under any legal obligation to obey a cop when told to violate the law.

It’s a urine drug screen and a breathe alcohol 9.9 times out of ten for any DOT worker. Trust me, I have done these things for decades. Our local Leo’s use blood alcohol testing.. which I find .wholly inaccurate. Due to the volatility. I have often asked myself what are they really doing asking for a blood sample.. it goes to the local bureau of investigation.
I can knock out a breath alcohol test in minutes. The local Leo’s don’t perform breathe alcohol.

“This isn’t the first time this Detective has had problems.”
___

This detective (Payne) and his supervisor need to be charged criminally, dismissed from the police force and made to pay personally for the injustice perpetrated on the nurse. In addition, the hospital security personnel that failed to intervene on behalf of the nurse should be fired for incompetence and cowardice.
