Chattanooga Seeks to Renounce Confederate Cemetery

Chattanooga is moving to renounce its position as a trustee of the Confederate Cemetery on East Third Street, according to a news release from Mayor Andy Berke's office.

"Our action today makes it clear that the City of Chattanooga condemns white supremacy in every way, shape and form," Berke said in the release.

"While we honor our dead, we do not honor the principle for which they fought. Our city should be invested in our future, not a discredited past. Confederates fought against America to preserve slavery. That is the truth, and we should no longer subsidize any myths to the contrary."

The release states the city is not on the deed for the land, but Berke also has asked City Attorney Wade Hinton to file paperwork to confirm Chattanooga is the city is no longer listed as one of the cemetery trustees.

Hinton said the city has allowed the Sons of Confederate Veterans to make repairs to the cemetery under the assumption the city owned the property. A review of records showed "this does not appear to be the case," Hinton said.

"There is no reason why we should have any responsibility for maintaining the Confederate Cemetery — a property we do not actually own."

The release said the terms of the cemetery trust have expired. It said the city will ask Hamilton County Chancery Court for a ruling on its status as a trustee and to determine who owns and must maintain the property.

Boy! I can’t think of anything that is a NOTHING BURGER more than this language.... People 30, 40, 50, 60, 70, 80 years old decide - Oh! No! We can’t have this.

Are they all descendants of Rip Van Winkle and been asleep in caves all these years? Doesn’t say much for their intelligence but when you’re on a roll, why stop to consider how stupid you are!

Do they all need attention this bad? SICK SICK SICK

Born and raised in Chattanooga. Boy would I love to see his family history. Must be a couple of CSA vets, not to mention a possible slave owner or two.

It is getting stupider by the moment. They are provoking a confrontation with anyone who will entertain them. This will not turn out good no matter what or who is the target there will be a flash point that they will regret

Some one should inform the Mayor of U.S. law ongressional Act of 9 March 1906 ~ We Honor Our Fallen Ancestors

(P.L. 38, 59th Congress, Chap. 631-34 Stat. 56)

This act authorized the furnishing of headstones for the graves of Confederates who died, primarily in Union prison camps and were buried in Federal cemeteries.

Remarks: This act formally reaffirmed Confederate soldiers as military combatants with legal standing. It granted recognition to deceased Confederate soldiers commensurate with the status of deceased Union soldiers.

U.S. Public Law 810, Approved by 17th Congress 26 February 1929

(45 Stat 1307 – Currently on the books as 38 U.S. Code, Sec. 2306)

This law, passed by the U.S. Congress, authorized the “Secretary of War to erect headstones over the graves of soldiers who served in the Confederate Army and to direct him to preserve in the records of the War Department the names and places of burial of all soldiers for whom such headstones shall have been erected.”
Remarks: This act broadened the scope of recognition further for all Confederate soldiers to receive burial benefits equivalent to Union soldiers. It authorized the use of U.S. government (public) funds to mark Confederate graves and record their locations.

U.S. Public Law 85-425: Sec. 410 Approved 23 May 1958

Confederate Iron Cross

(US Statutes at Large Volume 72, Part 1, Page 133-134)

The Administrator shall pay to each person who served in the military or naval forces of the Confederate States of America during the Civil War a monthly pension in the same amounts and subject to the same conditions as would have been applicable to such person under the laws in effect on December 31, 1957, if his service in such forces had been service in the military or naval forces of the United States.

Dig them up, put the corpses on trial, convict them of whatever it is that they believe dead people able to be guilty of, burn their remains and throw them in the river.

Worked for the Vatican back in the Dark Ages. Might as well go for it, welcome to the new Dark Age.

Or is that racist? Who knows. Some bliss-ninnie will be offended no doubt, that seems to be the only standard.

Just another avenue for the shibboleth that if you oppose an ever-expanding central government (in violation of the Constitution, by the way) you’re a racist, sexist, bigoted, homophobic, transphobic hater.

Chattannoga Child Mayor Andy Berke should know that both the USA and the CSA during the war had constitutions that enshrined slavery.

And both the USA and CSA had presidents that took oaths to uphold their nations’ pro-slavery constitutions. In fact, the USA’s president - President Lincoln - took the oath twice.
