What evidence?
The video showing some guy taking a cheap swipe at the back of the car with a stick or something, as the car, moving forward, passed him.
It will be a stretch to argue that that action alone caused the driver to panic, but when combined with any evidence of rocks being thrown, or any other physical threats, the defendant might try to make that argument.
Personally, I think he's in big trouble either way.
Earlier, on another thread, I had wondered if evidence of his political views would be admissible. I would speculate "yes", but I'm not a legal expert. If the answer to that question is "yes", then his ass is grass...
