Deputy Attorney General: Special counsel Mueller needs permission to expand Russia investigation

Deputy Attorney General Rod Rosenstein said on Sunday that the special counsel investigating Russia's interference in the 2016 election needs permission from the Department of Justice to expand his investigation if he finds evidence of an unrelated crime.

In an interview with Fox News Sunday, Deputy Attorney General Rod Rosenstein said special counsel Robert Mueller's investigation of Russia's role in the 2016 campaign and President Donald Trump's campaign's potential ties to Russia was "not a fishing expedition."

"If he finds evidence of a crime that is within the scope of what Director Mueller and I have agreed is the appropriate scope of this investigation, then he can," Rosenstein said. "If it's something outside that scope he needs to come to the acting attorney general, at this time me, for permission to expand his investigation."

Rosenstein’s authorization memo appointing Mueller does not state the grounds for the authorization:

• what violation(s) of law are suspected
• what evidence exists to support those suspicions

The U.S. Code of Federal Regulations requires that a special counsel not be appointed unless and until it is determined that there are grounds for a criminal investigation (28 CFR 600.1) yet Rosenstein has appointed a special council without specifying any criminal act to investigate! Rosenstein has violated regulations governing the appoint of a special counsel.

Rosensteins authorization to Mueller cites Comey’s testimony, “The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James B. Corney in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017...” Comey explicitly and unambiguously described a counterintelligence investigation, not a criminal investigation. Why is Rosenstein citing Comey?

Rosenstein’s authorization lacks grounding.

This guy is incompetent.

I’ve been saying the same thing for weeks.

The Washington Post and The New York Times are fake news outlets to conservatives, UNTIL they publish some particularly, anti-Trump “bombshell,” and suddenly, conservatives are terrified by the story.

How does Mueller "find something outside the scope of the investigation" without already expanding the scope of the investigation?

A prosecutor applies for a warrant to search Joe Blow's house for narcotics. A pile of evidence is handed to the judge to support the application. The search warrant is granted. So the prosecutor goes back to the judge and applies for an amended warrant to expand the original warrant to include evidence of additional crimes that was found while legally searching for evidence of the original crime.

So then Mueller could innocently stumble onto something, right? LOL. Or he could go on a fishing expedition, find something and then come back after the fact and get permission from Rosenstein to expand the scope. Correct??

Rosenstein doesn't addresses that concern in his comment. In fact he glosses over it. Read his comment again.

It’s not a question of faith. It’s just a practical matter in the real world of DC political intrigue.

Also, if you think for a minute that the career prosecutors in the DOJ’s Criminal Division wouldn’t love to have the symbolic scalps of Manafort and Gen. Flynn hanging on the walls of their offices, then I’ve got a bridge across the East River to sell you.

Last but not least, I believe Pres. Trump could solve all the related problems by issuing blanket pardons to Manafort, Flynn, Roger Stone, Carter Page and every other “questionable” person associated with his campaign. Why hasn’t he done so already? You tell me.

This has been carefully planned and coordinated by Comey, Rosenstein, and Mueller.

Recall that Rosenstein recommended Comey be fired. Recall also that Comey testified that his intention was to leak so that a special council would be created.

Comey to Rosenstein, Fire me.

Rosenstein: What?

Comey: I can't appoint a special counsel, you can. Fire me so that you can appoint a special counsel.

Rosenstein: Brilliant!

Comey: We can do this. We are the Resistance.

The Russia Narrative was losing steam and they needed to create an ongoing aura of wrongdoing. Comey could not appoint a special council, Rosenstein could. Getting Comey fired would feed the “obstruction” sub-narrative of the Russia Narrative and would create the optics needed to bull through the appointment of a special council.

It worked.

Rosenstein appointed his long-term associate Mueller, with whom Comey has coordinated his Congressional testimony.

The history of these three together, the blatant collusion of Mueller and Comey (Comey's testimony before Congress was delayed so that he could first meet with Mueller), the improper appointment of a special council, Mueller’s investigation of things far outside the scope of Rosenstein’s improperly created special council, Mueller staffing up with Democrat bundlers and Clinton Foundation lawyers....

Mueller and Rosenstein have discredited themselves. They have ZERO credibility.

We can pray but I don’t see Democrats prosecuting Democrats. Mueller’s team will only try and damage Trump.

It is nothing more than wishful thinking to believe that this investigation will go anywhere except against Trump. This is simply a set up by Rosenstein to increase the seriousness of the charges once the Grand Jury hands down their indictments. Rosenstein will be back on television to inform us that evidence found incidentally, about something else (financial), through the Russia investigation, was so significant he had to approve expanding the investigation.

Meanwhile, the recuser will sit and watch from a safe distance.
