You file a lawsuit simply stating that Dept of Ed is unconstitutional and in violation of the 10th Amendment.

That will get you a "bill" of another sort. Lawyers don't do that for free — somebody always pays.

And moreover, the Courts will tell you it is a political question. Have they ever even ruled against a program based on Art 1 Section 8?
