There is a constitutional solution: impeach and remove activist judges. There is some judicial leeway, but if there is a pattern of decisions that are outside that leeway, remove the activist from office.Agreed. That would actually work, but our system is fundamentally incapable of such action. There is no way to quantify 'activism' in any meaningful and objective manner.
The legal system is broken in a fundamental manner in just about any way you care to mention.

The solution is to start impeaching and removing the most egregiously activist judges. Work out a balance, where minor violator keep their jobs but never get promoted and major violators get removed from office. We can make that work by removing the worst among judges.
