President Donald Trump said on Wednesday that he is considering splitting up the U.S. Court of Appeals for the Ninth Circuit after its recent rulings that have blocked two of his executive orders.
"There are many people that want to break up the Ninth Circuit. It's outrageous," Trump said to the Washington Examiner in an interview at the White House. "Everybody immediately runs to the Ninth Circuit. And we have a big country. We have lots of other locations. But they immediately run to the Ninth Circuit. Because they know that's like, semi-automatic."

Question:
Why does the president have anything to say whatsoever about the jurisdiction of our inferior courts when the Constitution says that shall be established by Congress? I am aware that the practice has been to set these things by statute which, of course, requires the president's signature but am I missing something in the Constitution somewhere?

If my talk show listening and readings are correct, it is not a break up of the 9th, but a whole new circuit to make the 9th smaller. This new Court I think might be OR, Washington, Alaska, maybe Hawaii. Discussed here on FR, and I think ideas were floated for some rough and very cold place in Alaska for it's location ;-)....

Yes, indeed he is and I fully approve of what Trump is trying to do to bring the Ninth Circuit back into a sane world. My question is a matter of interpretation of the Constitution.
